Terms of Service

Welcome to Cole AI. These Terms of Service ("Terms") govern your access to and use of the Cole AI mobile application (the "App") operated by Cole AI ("Cole AI," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

2. Account Registration

To use certain features of the App, you must create an account using your email address and password, or by signing in through Google or Apple. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or in violation of these Terms.

3. Description of the App

Cole AI is a nutritional wellness application designed to help users track and improve their cholesterol health. The App provides:

• AI-powered meal photo analysis that estimates nutritional content relevant to cholesterol health
• A cholesterol health scoring system (1–100 scale)
• Daily, weekly, and long-term progress tracking
• Personalized nutritional feedback and recommendations
• Blood test tracking for cholesterol metrics (LDL, HDL, triglycerides)

4. Medical Disclaimer

By using the App, you acknowledge and agree that Cole AI is not responsible for any health decisions you make based on information provided by the App.

5. Subscriptions and Payments

5.1 Free and Paid Features

The App offers certain features for free and additional features through paid subscription plans ("Cole AI Pro"). Meal photo analysis and the camera feature require an active subscription or free trial.

5.2 Free Trial

We may offer a free trial period (currently 3 days) for new subscribers. At the end of the free trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial period ends. You may cancel your free trial at any time through your Apple App Store or Google Play Store account settings.

5.3 Subscription Plans

Cole AI Pro is available as:

• Monthly: Billed at the then-current monthly rate on a recurring monthly basis
• Yearly: Billed at the then-current annual rate on a recurring annual basis

Prices are displayed in the App at the time of purchase and may vary by region. All prices are subject to change, though any price changes will not affect active subscription periods.

5.4 Billing and Renewal

• Subscriptions are processed and billed through the Apple App Store or Google Play Store (the "Platform").
• Payment will be charged to your Platform account upon confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your Platform account will be charged for renewal within 24 hours prior to the end of the current billing period at the applicable subscription rate.

5.5 Cancellation

You may cancel your subscription at any time through your Platform's subscription management settings:

• iOS: Settings > Apple ID > Subscriptions > Cole AI
• iOS Alternative: App Store > Profile > Subscriptions > Cole AI
• Android: Google Play Store > Menu > Subscriptions > Cole AI

Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your current subscription period. No refunds or credits will be provided for partial subscription periods.

5.6 Refunds

Refund requests are handled by the applicable Platform (Apple or Google) in accordance with their refund policies. We do not process refunds directly. To request a refund, please contact Apple Support or Google Play Support.

6. User Content

6.1 Your Content

You retain ownership of any content you submit to the App, including meal photos, corrections, and health data ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Content solely for the purpose of providing and improving the App's services.

6.2 Meal Photo Analysis

When you submit a meal photo for analysis:

• The photo is sent to a third-party AI service (Google Gemini) for nutritional analysis
• The photo and analysis results are stored in our secure database
• You may delete individual meal records and their associated photos at any time through the App

6.3 Prohibited Content

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, or otherwise objectionable
• Infringes on any third party's intellectual property rights
• Contains malware, viruses, or harmful code
• Attempts to exploit or interfere with the App's AI analysis systems

7. Acceptable Use

You agree to use the App only for its intended purpose and in compliance with all applicable laws. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to access, tamper with, or use non-public areas of the App or our systems
• Reverse engineer, decompile, or disassemble any part of the App
• Circumvent, disable, or interfere with security-related features of the App
• Use the App to collect information about other users
• Use automated means (bots, scrapers) to access the App
• Attempt to bypass subscription requirements or access paid features without authorization
• Interfere with or disrupt the integrity or performance of the App
• Impersonate any person or entity

8. Intellectual Property

8.1 Our Intellectual Property

The App and its original content, features, functionality, design, and branding (excluding User Content) are and will remain the exclusive property of Cole AI and its licensors. The App is protected by copyright, trademark, and other intellectual property laws.

8.2 Feedback

If you provide us with feedback, suggestions, or ideas regarding the App, you grant us the right to use such feedback without restriction or compensation to you.

9. AI-Generated Content Disclaimer

The App uses artificial intelligence to analyze meal photos and generate nutritional estimates, scores, and recommendations. You acknowledge and agree that:

• AI-generated nutritional data is an estimate and may not be completely accurate
• AI analysis may misidentify ingredients, portion sizes, or nutritional content
• Scores, feedback, and recommendations are generated algorithmically and should be considered general guidance, not professional advice
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content
• You are responsible for verifying any nutritional information that is important to your health decisions

10. Third-Party Services

The App integrates with third-party services including Google (AI analysis), Supabase (data storage), RevenueCat (subscription management), and ContentSquare (analytics). Your use of the App may be subject to the terms and privacy policies of these third-party services. We are not responsible for the practices or availability of third-party services.

11. Disclaimer of Warranties

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cole AI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App, including nutritional estimates, scores, and health-related recommendations
• Unauthorized access, use, or alteration of your transmissions or content
• Any health decisions made based on information provided by the App

In no event shall our aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Cole AI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the App
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right
• Any claim that your User Content caused damage to a third party

14. Termination

14.1 By You

You may stop using the App at any time. You may delete your account by contacting us at support@coleai.app. Deleting the App from your device does not automatically cancel your subscription; you must cancel your subscription through your Platform's settings.

14.2 By Us

We may suspend or terminate your account and access to the App at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.

14.3 Effect of Termination

Upon termination, provisions of these Terms that by their nature should survive will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and, where appropriate, notify you within the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your applicable jurisdiction, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cole AI regarding the App.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
• No Agency: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and Cole AI.

18. Apple-Specific Terms

If you access the App through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Cole AI only, and not with Apple Inc. ("Apple")
• Apple has no obligation to furnish any maintenance and support services with respect to the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation
• In the event of any third-party claim that the App infringes that third party's intellectual property rights, Cole AI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary
